Monday, December , I make another trip there with a Ben, who is my class mate. It took us a few tries to actually locate the correct location for the civil case.We asked the security card for the location of the civil case, and he instructed us to the fifth, sixth and seventh floor. Ben and I looked at the seventh floor, but we didn't find any court in progress. Then, we went down to the sixth floor and there, we found a trial in session. We were the only two visitors on the floor. Everyone the in the court room looked at us funny. Ben and I weren't sure if we were allows to be in there at all.
The first thing we heard after entering the courtroom is people talking about damages, and I noticed there is a witness on the stand and an jury of fourteen people sit on the left of the court room. The plaintiff's lawyer was asking the witness questions regarding depositions, dates and some true facts regarding about the case. For the first 0 minutes, I could not pin point down on what the lawyers are trying to do, and what the case is about. A lot of stuff popped up while we were listening to the trail that were mentioned in class before, such as motion to dismiss, discovery, contract, and breach of contract. The civil case was Kayes vs. Columbia College. One of the things that I found very interesting that, the witness is an x-lawyer (Mr. Mistafa), and his license was suspended; therefore, he resigned from practice about one year ago to become a business consultant. On the plaintiff side (Kayes), there is one lawyer representing Kayes. On the defendant side, there were two lawyers (Mr. Hall, Mr. Garcia) representing Columbia College. As for the case, it involves a domain name, and website for Columbia College. Shawn Kayes's company believed to be the provider of a domain name for Columbia College. Columbia College signed a contract with Kayes leasing the domain name over a period of time. Something happened along the line, and Columbia College had breached its contract with Kayes. The defendant's lawyers questioned Mr. Mistafa on documents that he had signed and prepared when he was in charge of the case. Hall and Garcia pulled many questions on the witness, it seemed to me that they were trying to put down the witness credits and showed misrepresentation and negligence toward the witness. Mistafa on the other hand, was a lawyer himself; therefore, he knew the tricks and loops hole around all this. Through out the whole questionings, Mistafa never answered any question directly. I could see that, he techniquely toying around with the others lawyers.This court visit wasn't as bad as I expected; instead, it was rather fun and interesting. I observed the defendant's lawyers questioning Mistafa, there were many questions being asked, which I couldn't relate any special relationship toward the case. Mistafa continue answered the questions in a non serious attitude. Consequently, the honor judge make a comment in front of everyone and the jury toward Mistafa, warned him to watch his attitude and answer the questions right without any facial gestures. After the warning, Mistafa calmed down and answered his questions more properly. That went on for about half an hour, Mistafa probably bored and start playing game again. This time the judge stopped the court proceeding and sent the jury out side. After the jury had left, the honorable judge yelled at Mistafa for his behaviors, and warned him about fines, possible of custody. Then, the honorable judge called in three bailiffs into the court room, and brought back the jury.That was the end of all laughter in the court room, everything went smoothly both sides with the questionings.
